This source code is licensed, not sold. Usage is granted to the authorized client (Licensee) only who purchased a valid and documented license from Marketation, linked specifically to the legally registered domain.
The Licensee may not, directly or indirectly, without the express prior written consent of Marketation, perform any of the following:
- Resell, redistribute, lease, license, or sub-license this software or any part of its source code to any third party.
- Use this software for multiple domains or clients without purchasing additional separate licenses for each domain.
- Modify, decompile, disassemble, or reverse engineer the software for the purpose of creating a competitive product or extracting source code.
- Remove or alter any copyright notices, proprietary badges, or "Powered by Marketation" links within the software.
- Each installation is equipped with advanced tracking and multiple encrypted digital fingerprints tied to the registered domain name.
- These fingerprints continuously evaluate transactions and track the system against any unauthorized leaks or attempts to copy source files from the hosting.
- In case of unauthorized distribution or source code duplication without written consent, the Developer can fully identify the individual responsible for the leak.
- Marketation reserves the absolute right to withdraw the license or instantly and permanently shut down the system using the built-in emergency lock feature upon detecting any violation of these terms.
- In the event of unauthorized leaking, the company has the full right to legally prosecute the violator. The client waives all rights to legal claims, financial refunds, or compensation in such cases.
Support and updates are provided according to the terms agreed upon at the time of purchase. Marketation reserves the right to terminate technical support for any violated licenses.
- The software incorporates active protection mechanisms against unauthorized intrusions, malicious uploads, and SQL injection attacks.
- All vital transactions and admin actions are recorded within system audit logs to ensure total traceability and forensic evaluation.
- Any attempt to bypass, alter, or disable the security mechanisms will trigger an automatic system suspension pending company review.
Any unauthorized usage or code infringement subjects the offending party to comprehensive international and domestic civil/criminal legal action. The violator shall be liable for damages starting at $50,000 USD to cover IP damage, lost profits, and legal costs.
The software automatically pings Marketation servers to validate domain legitimacy and server IP as part of the Developer's legitimate interest to prevent piracy and protect intellectual property. Any attempt to modify, block, or bypass this automated verification (Ping Validation) will trigger an immediate permanent system shutdown.
The Licensee expressly and irrevocably agrees and grants the Developer full rights to suspend or terminate the system (Kill Switch) immediately upon detecting any breach of this agreement. The Licensee waives all rights to claim damages, lost profits, or business disruption resulting from such a security enforcement action.
This Agreement shall be governed by and construed in accordance with the following laws, which grant the Company full rights of immediate shutdown or direct prosecution:
- **Locally:** Intellectual Property Protection Law No. 82 of 2002 and Personal Data Protection Law No. 151 of 2020 of the Arab Republic of Egypt.
- **Internationally:** The Digital Millennium Copyright Act (DMCA) of the United States, the EU Software Directive (2009/24/EC), the General Data Protection Regulation (GDPR) in the EU, and the Berne Convention for the Protection of Literary and Artistic Works.
- Any legal disputes shall be settled exclusively in the competent courts of Egypt. However, Marketation reserves the right to take simultaneous legal action in Federal and local courts in the US and the European Union against any violators.
